1. Deposits & Payments

All orders require a 50% deposit to secure your chosen date. This deposit must be paid within 5 days of receiving an invoice. The full amount must be paid 2 weeks prior to the date of delivery or pick up. This deposit is non-refundable.

Should you order within 2 weeks of your chosen date, full payment is required immediately to confirm your order and secure your date.

Full payment must be made by the due date indicated on the invoice or contract is null and voice. Any deposit paid in this circumstances will not be refunded.

The date of your final payment (payment of the balance) is the final date for any changes of size, style or flavours in regards to your order. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

2. Cancellations & Date Changes

All deposits are non-refundable. Should you cancel your order, any paid deposits may be transferred to a new date subject to availability. However no refunds will be issued.

In the event the client wishes to change the date of the event, if changes are made more than 2 weeks prior to the event your deposit will be transferred to your new date subject to availability. If the new date is unavailable, the deposit may be held for up to 12 months for any other order; if not used within 12 months Sweets by Sas reserves the right to withold up to the full payment of the order.

In the event of a city/state/country wide lock down within the 2 weeks leading up to the event, that prevents the event from proceeding the deposit may be credited to a new date.

3. Allergens

While we do our best to ensure the kitchen is allergen free environment, we cannot guarantee that our products are nut, gluten, and/or any other type of common allergen free. We will always do our best to accommodate all allergies, and minimise the risk of cross-contamination, as all equipment and benches are thoroughly cleaned between uses, and allergy friendly ingredients are used upon request. It is, however, important to note that our kitchen and equipment is not an allergen-free zone and therefore may contain some traces of allergens.

Sweets by Sas will not be held responsible for anyone suffering allergies. It is the responsibility of the client to inform their guests that nuts, gluten and other allergens may be present.

4. Non-Edible Items

It is the responsibility of the client to ensure that all non-edible items and decorations are removed from the products prior to consumption.

5. Delivery/Pick Up

All products are made and packaged in a way to ensure that they are safe and stable throughout travel. Clients who wish to pick up their order are responsible for the safe travel of the product(s). Sweets by Sas does not accept responsibility for any accidents or damage which occurs to the product(s) once they have been collected. Once collected, by yourself or your representative, you assume all liability for the condition of the cake and/or other products once it leave the Sweets by Sas studio.

When a cake or other product(s) are delivered and/or assembled on site, Sweets by Sas is not responsible for any damage which occurs after setup is complete; including during movement of the cake. It is important to note that cakes and various other products may require refrigeration, and that their optimal room temperature is approximately 25C.

6. Product Damage

Should damage occur to the cake after collection or delivery, the client may request for Sweets by Sas to fix the cake prior to the event start time (subject ot availability). A call out fee will be incured and payment must be made at this time in cash or via bank transfer.

If you have ellected to have your order delivered via courier/post, Sweets by Sas accepts no responsibility for any damage that may be incurred once in the hands of the nominated courier/postal service

7. Refunds

Once an order is accepted via delivery or collected via pick-up no refunds will be be issued. If there is an issue with the cake/product, we request that you refrigerate or freeze the cake/product immediately, contact us and return the product to us as organised.

8. Photography

While all products are photographed prior to/upon collection/delivery, Sweets by Sas reserves the right to use any photography of our products without notification or compensation.

9. Stand Hire

A deposit of $50 is required for all stands and platters. Stands must be collected by the client after the event and returned to Sweets by Sas. The deposit is fully refundable upon return of the stand in its original condition, up to 48 hours after the event. The deposit will be forfeited should the stand be damaged in any way, and a fee of $15 per day will be deducted from the deposit for each day late unless prior arrangements have been made.

10. Itellectual Property

All custom cake designs that are made by Sweets by Sas remain the intellectual property of Sweets by Sas. Taking a design which has been custom designed to your specifications to another cake decorator is a breach of intellectual property. If you are found to be in breach of this clause, appropriate action will be taken.

11. Final Product

Please note that the customer accepts that the final product may not be an exactly replica of the sketch provided to you. The final product will not be an exact copy of any inspirations provided, due to creative influences and methods differing between dessert artists. The final product will, however, reflect the sketch drawn and specifications discussed, as documented in this contract.

Sweets by Sas reserves the right to creative variation to the design if deemed necessary.

12. Performance

Performance of this agreement is contingent upon the availability of the vendor to complete the agreement and is subject to accidents, Acts of God, and other causes beyond our controld. In such an event which prevents Sweets by Sas from providing the agreed upon service, we may refer the cake order to a different vendor or provide a refund of any payment made by the client above the non-refundable deposit.

CAKE refers to all edible products supplied by Sweets by Sas, including; but not limited to; Cakes, Cupcakes, Cookies, Cake Pops and Dessert Cups.

CLIENT refers to the person requesting an order from Sweets by Sas

VENDOR refers to Sweets by Sas

 

In paying the provided invoice; or making an online purchase, you are accepting the terms and conditions outlined on this page, and are responsible for all payments and decisions regarding this order. These terms and conditions are applicable to all custom orders as well as all orders placed through the online shop.
